Lawmakers and regulators, including in the United States, are intervening in core areas of expression, commerce and online infrastructure. Yet policy debates often overlook a crucial obstacle: the enforcement gap created by human behavior, rather than legal or technical shortcomings. Drawing on examples from AI, data privacy and platform regulation, this talk examines how behavioral dynamics, such as user adoption, compliance incentives and institutional capacity, can undermine or advance policy goals. Guest speaker Aileen Nielsen is a Visiting Assistant Professor at Harvard Law School, where she teaches privacy law and torts. Her research focuses on the interplay of law and technology, drawing on empirical methods and private law topics. She holds degrees in anthropology, physics, and law. She has written two trade books on machine learning and has also worked in industry as a data scientist. She is a member of the New York bar. A network of environmental funds of Latin America and the Caribbean has developed standards that address financial, social, and environmental capacities required for this transformation. One of its members, the Mexican Fund for the Conservation of Nature (FMCN) uses these standards to measure it’s eNectiveness. However, to fulfil its mission, FMCN needs strong local organizations. A system to identify the knowledge required to manage funds, as well as best environmental and social practices is underway. FMCN´s 30-year journey of mapping proven solutions, such as investing in protected areas, payments for ecosystem services, and no-take zones in fisheries will be presented. Challenges, such as scaling community enterprises, will be discussed together with academic contributions needed to identify the path for ensuring a more sustainable future.

The event is supported by the International Security Studies Program at Fletcher, the Department of History and the Center for South Asian and Indian Ocean Studies at Tufts. On December 24, 1979, the Soviet Union launched an invasion of Afghanistan—a watershed moment that reshaped the Cold War, triggered one of the largest covert operations in U.S. history and sowed the seeds of the decades-long war on terror from 9/11 to the Taliban takeover. What began as a proxy conflict at the crossroads of South, Central and West Asia reverberated across generations, fueling militant jihadism, transforming U.S. intelligence and military institutions, and altering the balance between national security and democratic accountability. We are pleased to welcome historian David N. Gibbs as our special guest. Drawing on recently declassified materials from U.S. and Soviet archives, he will explore the origins of the Soviet intervention in Afghanistan and the U.S. response. He will examine how American policymakers assessed the Soviet occupation and the ensuing ten-year guerrilla war, and he will argue that U.S. actions, while ostensibly serving immediate strategic objectives, ultimately contributed to long-term instability in Afghanistan and the conditions that gave rise to the war on terror. He will be joined in conversation by several Fletcher and Tufts professors, including Elisabeth Leake, Ayesha Jalal and Michael J. Glennon, who will bring perspectives on Middle Eastern, Central Asian and South Asian history and the legal dimensions of American national security. Moderated by Arik Burakovsky, Associate Director of the Center for Expanding Viewpoints in Higher Education, the discussion will revisit the Cold War origins of the conflict, explore the constitutional and institutional questions raised by covert action and trace Afghanistan’s long shadow over U.S. foreign policy.
